Berkeley Law Dean, Professor Debate Supreme Court's Conservative Shift at Student Event

According to The Daily Californian: A debate on the U.S. Supreme Court's 2026-27 term took place on Monday at Booth Auditorium, hosted by the Berkeley Federalist Society and the Berkeley Law chapter of the American Constitution Society.

About 175 students attended the event.

During the debate, Berkeley Law Dean Erwin Chemerinsky argued that the Supreme Court’s conservative majority shifted following the death of Justice Ruth Bader Ginsburg and the appointment of Justice Amy Coney Barrett. Chemerinsky’s argument was countered by John Yoo, who argued that the court has a majority of originalists and that justices should adhere to a judicial philosophy.

Chemerinsky also highlighted that the Supreme Court’s decision in Louisiana v. Callais will result in the largest loss of Black representation in Congress and state legislatures since the end of Reconstruction.
